Burwell: Guidance on march-in rights not needed

In a letter to Rep. Lloyd Doggett (D-Texas), HHS Secretary Sylvia Burwell declined to have NIH issue guidelines on when the agency may exercise its march-in authority under the Bayh-Dole Act.

The 1980 law allows NIH to require the holder of a patent underlying federally funded research to license the patent to other parties to "promote the utilization of inventions arising from federally supported research or development." ...
