The U.S. Court of Appeals for the Federal Circuit agreed to stay GSK's suit against the U.S. Patent and Trademark Office until 60 days after the Senate confirms a new undersecretary of commerce for intellectual property and director of the USPTO. As a result, oral arguments originally scheduled for Oct. 7 will be delayed. The CAFC recently agreed to rehear the suit, which concerns the agency's final rules concerning patent applications.
