A federal appeals court in New York reversed the preliminary injunction that had prohibited U.S. marketing of Novo's Norditropin human growth hormone. The product received FDA approval in May 1995, but marketing was enjoined under a preliminary injunction granted last year to GNE, which alleges that Novo's product infringes three of its patents.

The court has yet to schedule a trial on GNE's patent infringement claims against Novo and BTGC's Bio-Tropin. The latter received marketing approval last year. ...
