The U.S. Bankruptcy Court for the District of Massachusetts (Western Division) declared a non-exclusive patent license to be in effect between Institut Pasteur and CBCXE as of January 1, 1996, covering CBCXE's HIV-1 Western Blot test. The test is used to diagnose AIDS to confirm the results of less sensitive screening assays.

The ruling stems from a lawsuit filed by Institut Pasteur and Genetic Systems Corp. in March 1995 alleging that CBCXE infringed three patents owned by Institut Pasteur and licensed to Genetic Systems. ...
