Ostex, Boehringer Mannheim deal

OSTX filed in the U.S. District Court in Seattle, seeking to compel arbitration with Boehringer to terminate the licensing and distribution, and R&D agreement between the companies. The Seattle company alleges that Boehringer failed to meet marketing obligations under the October 1994 agreement.
Boehringer had received a worldwide, co-exclusive, 10-year license to distribute the Osteomark kits for testing bone resorption in the existing microtiter plate (MTP) format, and to adapt the test for use in automated systems and to manufacture and market the product worldwide, excluding Japan. ...
