A California Superior Court awarded $52.6 million to CALP in its 1999 suit alleging that ACLA misappropriated trade secrets. CALP said additional claims will be determined by the court at a later date. ACLA said it will appeal.

In a separate action, CALP said the U.S. District Court for the Northern District of California granted summary judgement that the company's LabChip products do not literally infringe ACLA's U.S. Patent No. 5,750,015 covering methods and devices for moving molecules via the application of electric fields. However, the court declined to make a summary judgement on the validity of the '015 patent under a separate infringement standard called the doctrine of equivalents, for which ACLA said a trial date is set for Dec. 4 (see BioCentury, May 3, 1999). ...
