PPRT filed suit against AHP in the Orange County (Calif.) Superior Court of the State of California alleging misappropriation of trade secrets and breach of contract. Under a 1997 agreement, PPRT has been providing standardized herbal products exclusively to AHP, including saw palmetto, St. John's wort, echinacea, ginkgo biloba, ginseng and garlic, to be marketed by AHP under its Centrum Herbal brand. The suit, which seeks an injunction and damages against AHP, alleges that AHP used PPRT's trade secrets to develop its own line of herbal combination products and that AHP failed to meet the agreed annual minimum for marketing expenses for the Centrum Herbal products.

Separately, AHP filed a breach of contract suit in the Superior Court of New Jersey alleging that PPRT's proposed line of combination herbal products violates the 1997 agreement and that PPRT did not meet other obligations under the deal. ...
