WuXi AppTec wins preliminary injunction in 1260H case

Judge rules DoD’s designation of WuXi AppTec as ‘Chinese military company’ was likely arbitrary and capricious

A federal court has sided with WuXi AppTec, issuing a preliminary injunction barring the Defense Department from enforcing its designation of the company as a “Chinese military company.” The court ruled that WuXi AppTec “has established a likelihood” that DoD's designation “was arbitrary and capricious under the Administrative Procedure Act.”

In an emailed statement, a Wuxi AppTec Co. Ltd. (Shanghai:603259; HKEX:2359) (药明康德) spokesperson said the “ruling relieves us from the immediate adverse consequences of the erroneous 1260H designation during the litigation process. We believe that the facts, as demonstrated in our court filings, will prevail after an objective and fair judicial review.”...
