ITC investigates smallpox vaccine claim

The U.S. International Trade Commission began an investigation related to a patent infringement complaint filed by Bavarian Nordic (CSE:BAVA) against Acambis (LSE:ACM; ACAM). The complaint alleges that ACM's Modified Vaccinia Ankara (MVA) viruses and MVA smallpox vaccine infringe patents owned by BAVA and use BAVA's trade secrets, which constitutes unfair competition in import trade under Section 337 of the Tariff Act of 1930. BAVA is seeking an order that would prohibit ACM from importing or selling its MVA vaccine in the U.S. The ITC will set a date to complete the investigation within 45 days.
