China's SIPO aims to strengthen IP protection

According to an analysis by law firm Covington and Burling LLC, China's State Intellectual Property Office has drafted amendments to existing patent law that would the strengthen the country's IP protections. The proposed changes include a fivefold increase in maximum statutory damages awarded to patent owners to RMB5 million ($780,500) from RMB1 million ($156,100).

The new provisions also would recognize indirect infringement, would allow courts to order defendants to disclose financial information, and would allow the state to confiscate infringing products and manufacturing equipment. Covington said the changes reflect China's interest in supporting stronger patent rights, encouraging use of patents, strengthening their enforcement and improving their quality. ...
