Benitec said the U.S. Patent and Trademark Office (USPTO) withdrew a novelty rejection, to Benitec's U.S. Patent No. 6,573,099. The company said two obviousness claims remain after the November Final Office Action, which rejected the patent. Benitec said it will appeal the obviousness rejections to the Board of Patent Appeals and Interferences and expects a decision in 2010. ...
