Ethypharm and Oscient filed suit against Lupin in the U.S. District Court for the District of Maryland alleging infringement of U.S. Patent No. 7,101,574 covering Ethypharm's lipid-lowering drug Antara fenofibrate. Ethypharm and Oscient were notified in December that Lupin submitted an ANDA to FDA for a generic version of fenofibrate.
