Vysis, a wholly owned subsidiary of Amoco Inc., and the University of California filed a new complaint against ONC, charging that ONC's marketing of imaging software products induces infringement of the university's chromosome painting patent, No. 5,447,841, which is licensed to Vysis. The complaint asks for a preliminary injnction to prevent ONC from marketing imaging software for Fluorescence In Situ Hybridization and Comparative Genomic Hybridization.
The complaint supplements an existing patent infringement suit against ONC filed in federal court last September in San Francisco. That suit charges ONC with infringing the '841 patent by the sale and use of unique sequence DNA probes together with blocking DNA. Vysis has begun offering non-exclusive licenses to the patent. ...
