Affymetrix, Incyte Genomics Inc. microarrays, genomics news

The companies settled their two ongoing lawsuits by cross-licensing their respective IP portfolios. A 1998 AFFX suit in the U.S. District Court for the Northern District of California claimed that INCY subsidiary Synteni Inc. infringed AFFX's patents related to high density DNA microarrays made using a solid surface (U.S. Patents Nos. 5,445,934; 5,744,305; 5,800,992; 5,871,928; and 6,040,193). In decisions this year, the court held that INCY's marketed cDNA arrays do not infringe the '934 or '305 patents and that some claims of the '992 patent are invalid (see BioCentury, Oct. 22).

In 2000, INCY filed suit in the same court claiming that AFFX infringed its patents related to non PCR-based RNA amplification (see BioCentury, Aug. 21, 2000). INCY's patents referenced in the suit were Nos. 5,716,785 and 5,891,636. ...
