At CGNE's request, the U.S. District Court for the Eastern District of California in Sacramento dismissed claims filed in February 1993 by the Davis, Calif., company, which charged ENZ with unfair competition and tortious interference in CGNE's January 1993 stock offering. The ruling awarded court costs of $5,000-$10,000 to ENZ.

The judge said he would issue a declaratory judgement that ENZ (Farmingdale, N.Y.) did not interfere with CGNE's offering, and that ENZ didn't unfairly compete with CGNE. The judge denied ENZ's request for repayment of ENZ's attorneys' fees. ...
