Medtronic said it received notice from the U.S. Department of Justice and the Office of the U.S. Attorney for the District of Massachusetts that federal prosecutors closed their investigation of Medtronic related to its marketed InFuse Bone Graft. The investigation began in October 2008 when the company received a subpoena requesting documents related to the product. Medtronic received several subsequent document requests related to the bone repair product, including a December 2008 civil investigative demand from the Massachusetts Attorney General's office, an October 2011 subpoena issued by the California Attorney General's office and inquiries from the U.S. Senate Finance Committee regarding concerns that medical researchers failed to report the risk of medical complications (see BioCentury, July 4, 2011).

Last year, Medtronic commissioned Yale University to review the safety and efficacy of InFuse. The move followed reports published in the Spine Journal in June 2011 alleging that the company failed to disclose financial ties to medical researchers involved in InFuse trials. ...
