DoJ seeks whistleblower case dismissal

The U.S. Department of Justice on Monday requested that a federal court dismiss a lawsuit filed by six current and former FDA medical device reviewers who claim the agency engaged in illegal surveillance and retaliatory personnel actions. The government said the plaintiffs are improperly simultaneously seeking both administrative and judicial relief and argued that the law requires that they exhaust administrative remedies before turning to the courts.
