EPO judge cautions patience

Although Amgen and Transkaryotic Therapies are scheduled to make post-trial motions tomorrow in their erythropoietin patent infringement lawsuit, U.S. District Court Judge William Young is making no promises about the speed of his decision in the case.

Both sides presented closing arguments on Friday in the U.S. District Court for the District of Massachusetts, but had been warned on Thursday that a decision might not be forthcoming immediately. "In the real world, this opinion is not written, it's not written even in significant draft form," Young said. "I, with the support of my team, am working on it. I'm going to go on working on it -- I've got to deal with the issues that are properly before me and I will do the best I can. And I'll do it as fast as I can. But I make no promises as to speed." ...
