The U.S. Supreme Court will hear Kappos v. Hyatt to decide whether a plaintiff in a Section 145 action can introduce new evidence that could have been presented to the PTO upon the initial filing and whether when new evidence is introduced, the court may decide de novo the factual questions to which the evidence pertains without regarding the PTO's decision.
