The U.S. Court of Appeals for the Federal Circuit ordered a rehearing and a new opinion from the panel that heard an appeal by AVE's Aventis CropScience S.A. group. The initial panel hearing related to a ruling by the U.S. District Court for the Middle District of North Carolina awarding damages to AVE from MON's DeKalb division related to DeKalb's sale of Roundup Ready corn. Though the court originally ruled that MON's DeKalb division infringed Rhone-Poulenc's (now Aventis CropScience's) U.S. Patent No. 5,510,471 covering the optimized transit peptide that imparts glyphosate tolerance to Roundup Ready corn, the ruling also the ruling acknowledged that MON is a bonified licensee of GA21 Roundup Ready Corn and that other divisions of MON are not restricted in marketing the product (see BioCentury Dec. 3, 2001). ...
