Twilight of HHS sunset rule

The Biden administration has taken a dim view of a Trump administration rule that sought to automatically terminate, or sunset, all HHS rules unless they had undergone an extensive review. In an announcement that it will postpone implementation for one year, HHS made it clear that it doesn’t plan allow the rule to ever see the light of day.

The proposed rule seeks to make regulations issued by any HHS agency, including FDA, CMS and CDC, automatically sunset 10 years after they have gone into effect unless the issuing agency undertakes a review and renewal process that has been described by opponents as cumbersome and time-consuming. ...
