Teva, Amgen resolve Neupogen patent suit
Teva Pharmaceutical Industries Ltd. (NASDAQ:TEVA) and Amgen Inc. (NASDAQ:AMGN) resolved patent litigation in the U.S. District Court for the Eastern District of Pennsylvania related to a Teva biologic that Amgen claimed infringes its Neupogen filgrastim. As part of the settlement agreed to in the court, Teva admitted that its Neutroval ( XM02) infringes two U.S. patents covering Neupogen and agreed not to sell Neutroval in the U.S. until after Nov. 10, 2013.
Amgen's U.S. Patent Nos. 5,580,755 and 5,582,823 expire in early December 2013. The settlement terms do not include any financial payments between the parties. Neupogen, a human granulocyte colony-stimulating factor (G-CSF), is indicated to reduce the duration of severe neutropenia and the incidence of febrile neutropenia in patients treated with established myelosuppressive chemotherapy for cancer. ...
