Invitrogen sues Incyte

IVGN filed suit against Incyte in the U.S. District Court for the District of Delaware alleging that INCY infringes three IVGN patents covering RNase H minus reverse transcriptase and its use to clone cDNA molecules. The U.S. Patents (nos. 5,244,797; 5,668,005 and 6,063,608) were issued to Life Technologies, which IVGN acquired last year. Although INCY purchased IVGN's commercial products covered by the patents, IVGN claims that INCY ignored the research-use-only restriction associated with the products by using them for commercial purposes.
