In two suits, LEXG alleged that DGEN's production of knockout mice infringed two separate areas of LEXG's intellectual property: engineering animal genomes using isogenic DNA technology and the use of positive-negative selection vectors to produce knockout mice (see B8). DGEN had filed a declaratory judgement in the isogenic DNA matter and denied that it used positive-negative selection vectors. It never counter-sued to allege that LEXG had infringed its own technology.

In the settlement, LEXG receives a free look at the fruits of DGEN's labors in the form of its database of targets, while DGEN's reward is less concrete, coming the form of peace of mind and potential milestones and royalties down the road...
