A ruling but no decision

Both sides are claiming victory following a European Patent Office ruling in the antibody patent dispute between Cambridge Antibody Technology Group plc and MorphoSys AG. But still unresolved is whether MorphoSys' antibody technology infringes Cambridge Antibody's Winter II patent.

Winter II (European Patent No. 368 684) covers CAT's antibody gene expression libraries. In its decision last week, EPO ruled that claim 32 of the patent, which originally covered all antibody libraries created by any method, should be amended to narrow its scope (see B6). ...
