Patent in hand, Enzo strikes back at CGNE

Enzo Biochem Inc. (ENZ) filed suit in the U.S. District Court for the District of Delaware seeking a permanent injunction and damages against Calgene Inc. (CGNE), charging patent infringement and acts of unfair competition. ENZ also alleges that CGNE misled the Patent and Trademark Office, and asks that CGNE's genetic antisense patent be invalidated.

ENZ holds exclusive rights to U.S. Patent No. 5,190,931, which issued last week to The Research Foundation of the State University of New York (SUNY). It covers both materials and methods related to genetic antisense technology. ...
