Calgene Inc. on Friday won its three-year federal court battle against Enzo Biochem Inc. in their dispute over antisense patents.

In an 86-page opinion, Judge Joseph Farnan of the U.S. District Court for the District of Delaware rejected ENZ's claim that CGNE infringed antisense patents issued to ENZ and ruled that ENZ's three issued antisense patents are invalid because the disclosures in the patents don't enable others to practice the claimed invention. In addition, the judge held that CGNE's patent is valid.
